General Terms and Conditions

The User agrees to:

• Provide all necessary means and technical requirements to access the Website.

• Use the Website and its content and services in a proper and lawful manner in accordance with:

  (i) the applicable legislation at all times,

  (ii) the General Terms and Conditions of Use of the Website;

  (iii) the generally accepted morals and customs, and

  (iv) public order.

• Provide truthful information when completing personal data forms on the Website and to keep it updated at all times so that it reflects the User’s real situation. The User will be solely responsible for any false or inaccurate statements made and for any harm caused to CAVIRO FOOD S.L.U by the information provided.

However, as per the previous section, the User must also refrain from:

• Making unauthorized or fraudulent use of the Website and/or its contents for illicit or prohibited purposes under these General Terms and Conditions of Use, violating the rights and interests of third parties, or in any way that could damage, overload, deteriorate, or impede the normal use of the services or documents, files, and all types of content stored on any computer system.

• Accessing or attempting to access restricted resources or areas of the Website without meeting the conditions required for such access.

• Causing damage to the physical or logical systems of the Website, its providers, or third parties.

• Introducing or spreading computer viruses or any other physical or logical systems that could cause damage to the physical or logical systems of Kamarere, its providers, or third parties.

• Attempting to access, use, or manipulate Kamarere’s, third-party providers’, or other Users’ data.

• Reproducing, copying, distributing, making public through any form of communication, transforming, or modifying the content unless authorized by the holder of the corresponding rights or as legally allowed.

• Removing or manipulating the intellectual or industrial property rights and other identifying data of Kamarere or third parties embedded in the contents, as well as technical protection devices or any information mechanisms that may be inserted into the content.

• Obtaining and attempting to obtain the content using methods or procedures other than those made available for such purpose or explicitly stated on the pages where the content is located, or generally using methods typically employed on the internet that do not pose a risk of damage or impairment of the Website and/or its contents.

In particular, and by way of example and not exhaustively, the User agrees not to transfer, spread, or make available to third parties information, data, content, messages, graphics, drawings, sound and/or image files, photographs, software, and generally any type of material that:

(i) Is in any way contrary to, undermines, or violates fundamental rights and public freedoms recognized constitutionally, in international treaties, or in other applicable legislation.

(ii) Introduces, incites, or promotes criminal, defamatory, denigrating, violent acts, or, in general, actions contrary to the law, morals, generally accepted customs, or public order.

(iii) Induces or encourages engagement in dangerous, risky, or harmful practices for health and mental well-being.

(iv) Incorporates, makes available, or allows access to illegal, violent, offensive, harmful, degrading products, elements, messages, and/or services or, in general, content contrary to the law, morals, and generally accepted good customs, or public order.

(v) Induces or may induce an unacceptable state of anxiety or fear.

(vi) Induces or encourages engagement in practices that are dangerous, risky, or harmful to health and mental balance.

(vii) Is protected by intellectual or industrial property laws belonging to Kamarere or third parties without authorization for the intended use.

(viii) Is contrary to honor, personal and family privacy, or the image of individuals.

(ix) Constitutes any kind of advertising.

(x) Includes any virus or program that impedes the normal functioning of the Website.

If a password is provided to access some of the services and/or content on the Website, the User is obliged to use it diligently, keeping it secret at all times. Consequently, the User will be responsible for its proper custody and confidentiality, committing not to give it to third parties, either temporarily or permanently, nor to allow access to the mentioned services and/or content by unauthorized persons. The User is also obliged to notify CAVIRO FOOD S.L.U of any event that may involve improper use of the password, such as its theft, loss, or unauthorized access, so that it can be immediately canceled. As a result, until the above notification is made, CAVIRO FOOD S.L.U will be exempt from any responsibility arising from improper use of the password, and the User will be responsible for any unlawful use of the Website’s content and/or services by any illegitimate third party.

If the User negligently or willfully breaches any of the obligations established in these General Terms and Conditions of Use, they will be responsible for all damages and losses that may arise from such a breach for CAVIRO FOOD S.L.U.
